By creating an account on CapyTrade ("the Platform"), you agree to be legally bound by these Terms of Service, together with the Privacy Policy below. If you do not agree, do not create an account or use the Platform.

CapyTrade is an educational technology platform that provides algorithmic swing trading signals, watchlist management, market analytics, and related data visualization tools. The Platform is provided for informational and educational purposes only. CapyTrade does not provide investment advice, manage investments, execute trades, accept client funds, or act as a broker or intermediary. CapyTrade is not registered with the U.S. Securities and Exchange Commission as an investment adviser and is not a member of FINRA. CapyTrade relies upon the "publisher's exclusion" under Section 202(a)(11)(D) of the Investment Advisers Act of 1940.

Nothing on CapyTrade constitutes financial, investment, legal, tax, or accounting advice. All signals, indicators, and data are generalized educational information and not personalized to your financial circumstances. You are solely responsible for your own trading decisions. You should consult with a licensed financial advisor, broker-dealer, CPA, or attorney before making any financial decisions.

Trading securities involves substantial risk. You acknowledge that trading stocks, options, and derivatives may result in rapid and substantial losses, including the entire amount of capital used for trading. Swing trading, momentum trading, and short-term speculation are particularly high-risk activities that may expose you to liquidity risk, volatility risk, execution risk, technology failures, and regulatory changes. Past signal performance does not guarantee future results. CapyTrade does not evaluate whether trading is suitable for you.

Performance examples, backtested results, and signal history provided through the Platform may be hypothetical or simulated. Such results have significant limitations including lack of real market execution, hindsight bias, liquidity differences, slippage, and transaction costs. Hypothetical results do not represent actual trading and should not be relied upon as a guarantee of future performance.

Employees, affiliates, or contractors of CapyTrade may trade securities for their personal accounts, including securities mentioned or discussed on the Platform. Such persons may buy, sell, or hold positions in securities before, after, or simultaneously with publication of any commentary. CapyTrade has no obligation to disclose these holdings.

You must be at least 18 years old to use the Platform. By registering, you represent that you meet this requirement and have the legal capacity to enter into binding agreements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. You may not share login credentials or allow others to access your account.

You may not use the Platform for any unlawful purpose, attempt to reverse-engineer the signal logic or algorithms, scrape or redistribute data, resell or republish proprietary content, or interfere with the Platform's operation. Unauthorized distribution may result in account termination and legal action.

All content within the Platform is the exclusive property of CapyTrade, including software, algorithms, analytics tools, research, educational content, design, and graphics. Subscribers may not redistribute content, share login credentials, resell materials, or publish proprietary information.

To the fullest extent permitted by law, CapyTrade and its operators are not liable for any trading losses, lost profits, indirect, consequential, or incidental damages arising from use of or reliance on the Platform. Use of signals is entirely at your own risk. Total liability, if any, shall not exceed the amount paid for your subscription during the preceding 12 months.

You agree to indemnify and hold harmless CapyTrade and its officers, directors, employees, contractors, and affiliates against any claims arising from misuse of the Platform, violation of these Terms, or trading losses based on Platform content.

We reserve the right to modify these Terms at any time. Updates will be posted with a revised effective date. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

We reserve the right to suspend or terminate accounts at our discretion, including for violation of these Terms.

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any disputes shall be resolved in the courts located within Texas.

We collect the information you provide when creating an account: username, email address, and hashed password. We also record your acceptance of these policies, the timestamp and IP address at which you accepted them, and your browser/device information for security purposes.

Your information is used solely to operate your account, send transactional emails (e.g., email verification, password reset), and deliver trading signal alerts you have opted into via Discord or Telegram.

Account data is stored securely in Cloudflare KV storage. Passwords are stored as cryptographic hashes and are never stored in plaintext. No payment information is stored on our servers.

We do not sell, trade, or share your personal information with third parties, except as required to operate the service (e.g., Resend for transactional email delivery) or as required by law.

If you choose to connect your Discord account, your Discord user ID and username are stored to enable direct message alerts. This connection can be removed at any time from your account settings.

If you choose to connect your Telegram account, your Telegram chat ID is stored to enable direct message alerts. This connection can be removed at any time from your account settings.

The Platform uses cookies solely for session authentication (JWT). No advertising or tracking cookies are used.

Your account data is retained as long as your account is active. You may request account deletion by contacting us, after which your data will be removed.

You have the right to access, correct, or request deletion of your personal data. Residents of California may have additional rights under the California Consumer Privacy Act (CCPA). Contact us to exercise these rights.

We may update this Privacy Policy periodically. We will notify registered users of material changes via email. Continued use of the Platform after changes constitutes acceptance of the updated Policy.
